Who must post the Los Angeles County, CA No Employee Retaliation Poster?

  • Any employer that employs or exercises control over the wages, hours, duties or working conditions of any workers who work within the unincorporated areas of Los Angeles County, California, is required to post the No Employee Retaliation Poster. (L.A.C.C. § 11.01.035)
  • The No Employee Retaliation Poster must be posed in a conspicuous place at any workplace or job site within unincorporated areas of Los Angeles County where any covered worker works.
  • Employers who do not have a physical jobsite in an unincorporated area of Los Angeles County must provide a copy of the notice to each covered worker.

 

Los Angeles County No employee Retaliation Poster Details:

The poster describes worker protections under Los Angeles County’s public health anti-retaliation ordinance (L.A.C.C. § 11.01.010, et. seq.), including:

  • Employers are prohibited from discriminating against an employee for:
    • Reporting or discussing the employer’s or other worker’s perceived noncompliance with a Health Officer Order or any violation of the Los Angeles County Health and Safety Code.
    • Belonging to or forming a Public Health Council.
    • Exercising any right under the public health anti-retaliation ordinance.
  • Employers are prohibited from retaliating or discriminating against an employee for discussing, complaining about, or providing information about workplace violations of public health laws, rules, and regulations to the Los Angeles County Department of Public Health, any other County departments or designees, or to non-County agencies or entities.
  • Examples of retaliation include a reduction in hours, change of shift time, change of workplace responsibilities, termination, demotion, or pay reduction.
  • Employees who have experienced retaliation for filing or discussing a public health violation are encouraged to file a complaint with the Los Angeles County Department of Consumer and Business Affairs, Office of Labor Equity. Contact information is provided.
