New California labor laws went into effect on January 1, 2015, giving employees greater protections and rights and imposing new responsibilities on employers. Each law carries a workplace posting requirement applicable to all California employers.
Paid Sick Leave
The Healthy Workplaces/Healthy Families Act of 2014 (CA AB 1522) is California’s new paid sick leave law. Under the law, starting July 1, 2015 employees that work in California for 30 or more days within a year will be entitled to 24 hours or three days paid sick leave annually.
Employees accrue 1 hour of paid sick leave for every 30 hours worked, paid at the employee’s regular wage rate. Up to three days paid leave can be carried over to the next year, except where the employer has a paid leave or paid time off policy with three days available from the start of each year. The law also requires employers to post a notice for employees describing the entitlement and usage provisions, as well as the protection from retaliation for requesting or using paid sick days.
Workplace Discrimination & Harassment
Changes for several new laws have been incorporated onto California’s Workplace Discrimination and Harassment posting.
Harassment: Unpaid Interns – An amendment to the California Fair Employment and Housing Act (CA AB 1443) adds unpaid interns and volunteers to the classes of individuals protected from discrimination and harassment in the workplace.
Driver’s Licenses: Nondiscrimination – Another new law (CA AB 1660) prohibits employers from discriminating against individuals who hold a type of driver’s license that does not require proof of legal presence in the U.S.
Discrimination and Harassment: Education – A new law (CA AB 2053) was enacted that adds abusive conduct prevention as a required component of the mandatory biennial sexual harassment training required for supervisors working for employers with 50 or more employees.
Cal/OSHA Job Safety and Health Protection on the Job
The Cal/OSHA workplace posting has also been updated with current contact information for district offices. Two new locations, American Canyon and Redding, have been added to the posting. The Concord and Santa Rosa locations were removed. Cal/OSHA considers having current contact information a priority.
