Montana Clean Indoor Air Act
The Montana Clean Indoor Air Act requires all enclosed public places and workplaces, including work vehicles, or vehicles that serve as a place of work, and vehicles accessible to the public to prominently display smoke-free signs on all public entrances.
Under the Act, “public place” includes, but is not limited to:
• Restaurants
• Stores
• Public and private office buildings
• Trains, buses, and other forms of public transportation
• Health-care facilities
• Auditoriums, arenas, meeting rooms, and other assembly facilities
• Bars
• Public schools
• Buildings that house community colleges and the state university system
“Smoking” and “no smoking” includes the act of lighting, smoking, or carrying a lighted cigar, cigarette, pipe, or any smokable product and includes the use of marijuana.
Posting Requirement
Managers or proprietors of enclosed public places are required to post conspicuous signs at all entrances indicating that smoking is prohibited. (Montana Code Annotated, Sec. 50-40-104)
