North Dakota Department of Labor and Human Rights Releases Updated Minimum Wage Poster

Recently the North Dakota Department of Labor and Human Rights released an updated Minimum Wage & Work Conditions Summary Notice which contains important administrative changes. Employers must have the updated version on break room walls for employees to view.

Changes to the Minimum Wage & Work Conditions Summary poster include:

  1. The addition of a new section “Limitations on Paid Time Off” which addresses that a private employer may withhold payment for accrued paid time off under three (3) specific conditions when an employee voluntarily separates from employment
  2. Clarification to the “Deduction from Pay” section outlining those deductions that are considered legal under state and federal law
  3. Definition of “service employee” and respective examples have been added to the “Tip Credit” section
  4. Addition of two (2) bulleted paragraphs to the “Exemptions from Overtime” section.
  5. Address highly compensated employees and describe who they are and weekly pay amounts and duties, and
  6. Employees providing companionship services outlining duties and that no more than 20% of the hours worked in the week may be household work (cleaning, laundry, or meal preparation).
