Healthy Families & Workplaces Act (HFWA)

  • In 2020, HFWA provides up to two weeks (80 hours) paid leave to an employee who:
    • has C-19 symptoms and is seeking medical diagnosis
    • has been instructed to quarantine or isolate due to C-19 risk
    • is taking care of a family member ordered to quarantine or isolate, or their child’s school or care provider is closed or unavailable due to C-19
  • Beginning in 2021, covered employers must provide up to 48 hours of paid leave for a wider range of health and caregiving reasons, and up to 32 hours additional paid leave for reasons related to a public health emergency.

Public Health Emergency Whistleblower Law (PHEW)

  • In a public health emergency, it is unlawful to retaliate against an employee or independent contractor for:
    • raising a reasonable concern about workplace violations of government health or safety rules, or a  significant workplace threat to health or safety
    • opposing any practice the worker reasonably believes is unlawful under PHEW
    • testifying, assisting, or participating in an investigation or proceeding concerning a violation of PHEW
  • A worker must be allowed to voluntarily wear their own Personal Protective Equipment (PPE), such as masks, faceguards or gloves, if that PPE meets certain safety standards.

Who Must Post?

The Colorado Department of Labor and Employment requires the Colorado Paid Leave, Whistleblower and Personal Protective Equipment Poster to be posted on the premises of every employer and covered principal until Dec. 31, 2020. The poster must be replaced with the 2021 poster by Jan. 1, 2021. (C.R.S. 8-13.3-408; 8-14.4-103)
