Tennessee Updates Wage Regulations Posting

2017 Tennessee Wage /Child Peel 'N PostDuring the 2017 legislative session, lawmakers passed House Bill 419’s amendments to Tennessee’s Wage Regulations Act, which provides protections for employees in the payment of wages. Prior to the passage of HB 419, all wages and other compensation of employees in private employment were due and payable at least semi-monthly (twice per month).

The new law lowers the required frequency of wage payments to at least once per month.  For employees on a once-monthly wage payment schedule, any wages earned and unpaid prior to the first day of the month are due and payable by the 5th of the succeeding month. HB 419 went into effect upon signing on May 11, 2017.

In accordance with the new law, the Tennessee Department of Labor and Workforce Development has revised its Wage Regulations Act notice, which is published as a dual posting with the Child Labor Act notice. This notice was last updated in 2015. Along with the revised statement regarding the required frequency of wage payments, the Department has made some minor design changes to the posting which affect its visual appearance.

Under the Child Labor Act, employers with workers under the age of 18 are required to post the Child Labor Act notice created by the Department in a conspicuous place in the workplace. Under the Wage Regulation Act, private employers with 5 or more employees are required to post and maintain notices setting forth the regular pay day in at least two conspicuous places where they can be seen by employees as they go to and from work. The Department of Labor and Workforce Development provides the Wage Regulations Act / Child Labor Act posting for this purpose, with a space for employers to fill in the mandatory payday information. It is listed by the Department as a Required State Poster for Tennessee Employers.
