During New York’s 2023-2024 legislative session, Assembly Bill 6328 and Senate Bill 3255 were passed amending the New York Human Rights Law. Under Assembly 6328, employers are prohibited from discriminating against employees and job applicants based on citizenship and immigration status. Citizenship or immigration status is defined as “the citizenship of any person or the immigration status of any person who is not citizen of the United States.” Under Senate Bill 3255, the statute of limitations for discrimination and retaliation claims is extended from one year to three years. The New York Discrimination posting has been revised to reflect these amendments to the law.
Posting Requirement
Every employer, employment agency, labor organization, and labor-management committee subject to the New York Human Rights Law must post and maintain at is offices, places of employment or employment training notices, the New York Discrimination posting. (9 NYCRR § 466.1)
