Who must post the Maryland Safety & Health Protection on the Job posting?

  • All Maryland employers must post the Maryland Safety & Health Protection on the Job posting to keep their employees informed of their protections and obligations under the Maryland Occupational Safety and Health (MOSH) Act. (Md. Lab. & Emp. § 5-104).
  • Employers must post the MOSH posting in a conspicuous place in each location where employees carry out their work activities, in places where employee notices are customarily posted for the location.
  • Employers must ensure that the MOSH posting is not altered, defaced, or covered by other material.

 

What’s new?

  • Because Maryland operates its own Federal OSHA-approved State Plan, the State Plan penalties must be “at least as effective as” as Federal OSHA’s. [29 CFR § 1902.3 (d)(1)].
  • Like Federal OSHA, the State Plan is required to annually adjust for inflation the maximum civil penalties for MOSH violations. (Md. Lab. & Emp. Code § 5-810).
  • The Maryland 2025 MOSH posting has been updated to reflect that the maximum and minimum civil penalties for violations of occupational safety and health standards have been adjusted for inflation. Key changes:
    • Although the 2024 civil penalty amounts were not removed from the posting, the web address where the inflation-adjusted civil penalty amounts for violations occurring on or after July 15, 2025, has been added to the posting.
    • The address of the Regional Administrator, U.S. Occupational Safety and Health Administration (OSHA), has been updated.

 

MOSH penalty maximums & minimum willful amounts effective July 15, 2025:

  • Violations – Maximum $16,550 per violation
  • Failure to Abate/Correct Violations – Maximum $16,550 per day
  • Willful or Repeated Violations – Maximum $165,514 per violation
  • Willful violations – Minimum $16,550 per violation
