A recent federal court order found that a Wisconsin statute was contrary to federal law, meaning many individuals previously found ineligible for Wisconsin Unemployment Insurance (UI) benefits due to receiving Social Security Disability Insurance (SSDI) benefits may now qualify for those past UI payments. Individuals may now be eligible for past Wisconsin UI benefits if they meet all other UI eligibility requirements and:
- They were receiving SSDI benefits.
- Their initial UI claim was filed on or after September 8, 2015, through July 29, 2025.
- And during that period, they were either:
- Denied an initial claim for Wisconsin UI solely because they received SSDI benefits, or
- Required to repay Wisconsin UI benefits solely because they received SSDI benefits.
Posting Requirement
Wisconsin employers covered by Wisconsin’s Unemployment Insurance Law must display this poster in the workplace until January 12, 2026.
