Under Section 265.01-e of the New York Penal Code, it is a criminal offense to possess a firearm, rifle, or shotgun in any area designated as a “sensitive location.”
Sensitive locations are listed as:
- Government buildings and courts
- Healthcare and behavioral health facilities
- Places of worship (except security)
- Libraries, playgrounds, public parks, and zoos
- Childcare providers and programs for youth
- Nursery schools, preschools, and summer camps
- Facilities for people with developmental disabilities
- Addiction services and supports locations
- Mental health program locations
- Temporary and disability assistance program locations
- Homeless and domestic violence shelters
- Residential settings regulated by the Department of Health
- Schools, colleges, and educational institutions
- Public transportation, vehicles, and hubs (airports, stations)
- Establishments licensed for on-premise alcohol or cannabis consumption
- Performance venues, stadiums, museums, and gaming facilities
- Polling places
- Public areas restricted for special events or by permits
- Protests and public assemblies
- Times Square (as identified by NYC)
Criminal possession of a firearm, rifle or shotgun in a sensitive location is a class E felony.
Posting Requirements
Managers or owners of property designated as a “sensitive location” under Section 265.01-e of the New York Penal Code may post the No Firearms Poster to provide clear notice to the public.
