Connecticut Electronic Monitoring

Under Connecticut General Statutes § 31-48d, any employer that conducts electronic monitoring must provide prior written notice to affected employees. For employees hired on or after October 1, 2026, employers must deliver a written notice prior to their start of employment. This notice must inform employees of the specific types of monitoring that may occur and the physical locations on the employer’s premises where the monitoring takes place.

Electronic monitoring is defined as the collection of information on an employer’s premises regarding employee activities or communications by any means other than direct observation. This includes the use of computers, telephones, wire, radio, cameras, electromagnetic, photoelectronic, or photo-optical systems. However, electronic monitoring does not include the collection of information for security purposes in common areas held out for public use, monitoring conducted during criminal investigations, or monitoring prohibited under state or federal law.

Posting Requirement

Covered employers must display this notice in a conspicuous place readily accessible for viewing by employees. In addition to general postings, employers are required under CGS § 31-48d(b)(1) to post notice in the specific locations on the premises where monitoring physically occurs, unless a statutory security exception applies.
