The New York City Job Hunter’s Bill of Rights Poster informs individuals using employment agencies of their rights.
An individual has the right to:
- earn at least the minimum wage at any job
- receive a copy of the contract
- refuse to pay illegal fees
- receive a full or partial refund within 7 days of the request if the agency charged an advance fee, deposit fee, registration fee, application fee, or interview fee
- be free from discrimination
- file a complaint
The poster also informs individuals that employment agencies must:
- be licensed by the Department of Consumer Affairs in order to operate in the City of New York
- only refer individuals to employers hiring
- provide individuals with a contract, a separate document summarizing the terms and conditions of the contract, and a receipt for each payment
- provide domestic workers with a Statement of Employee Rights and Employer Responsibilities and a Statement of Job Conditions.
Posting Requirements
All employment agencies in the City of New York must display the Job Hunter’s Bill of Rights Poster in the main reception or waiting area or where no reception or waiting area exists, the main entrance to the agency. The poster must be at least 8.5 inches by 11 inches.
An employment agency is defined as: “any person who for a fee, procures or attempts to procure: (1) employment or engagements for persons seeking employment or engagements, or (2) employees for employers seeking the services of employees.”
All New York City employment agencies are also required to post the Employment Agency Laws Poster in the main reception or waiting area.
