Who needs the California Survivors of Violence Right to Leave and Accommodations Pamphlet?

Employers are required to provide the California Survivors of Violence Right to Leave and Accommodations Pamphlet, officially known as, “California Survivors of Violence and Family Members of Victims Right to Leave and Accommodations” to new employees at time of hire, to all employees annually, and to existing employees upon request, to inform them of their rights under Govt. Code § 12945.8(K)(2).

What is covered in the Pamphlet?

The California Survivors of Violence Right to Leave and Accommodations Pamphlet describes the rights of employees who are victims of crime or abuse to take time off from work for specified purposes to protect themselves and their family member’s health, safety, or welfare.

All Employees:

All employees, regardless of the size of the employer, have the right to take time off:

  • To serve on a jury or to appear in court as a witness to comply with a subpoena or court order
  • To take steps to protect health, safety, and welfare if the employee or the employee’s child is a victim of violence
  • To attend certain judicial proceedings if the employee or the employee’s child is a victim of specified crimes

 

Employees of employers with 25 or more employees:

If an employee or a family member is a victim of violence and the employee works for an employer with 25 or more employees, the employee has the right to take time off:

  • To take part in safety planning
  • To attend or participate in legal proceedings related to the violence
  • To provide or arrange childcare or dependent adult care to protect against future violence
  • To care for a family member recovering from injuries caused by violence
  • To get or help a family member get specified services and handle certain needs arising from the violence

 

Other information:

  • If the employee works for an employer with 25 or more employees, the amount time off an employee can take for a covered reason
  • Regardless of the employer size, employees can use available vacation, paid time off, personal leave, or paid sick leave for a covered reason
  • Other laws that may give employees additional protections
  • Employees are protected from discrimination and retaliation and how to file a complaint
