Electronic posting is not a substitute for physical posting. For employees that perform work offsite, employers may supplement physical workplace postings by distributing to employees physical copies of labor law notices or by providing them with access to electronic postings. However, in every state, full compliance with posting requirements can only be achieved by physically posting labor law notices on the employer’s premises.
The law requires that postings be displayed in conspicuous places of the workplace in locations where employees congregate. Many notices must meet specific visual size, font and color requirements. Some notices must be posted such that they are visible to both job applicants and employees. Only a limited number of laws permit electronic posting of individual notices.
Ensure that you have properly posted notices. Penalties for failure to post required notices in the workplace may be assessed per violation, per day and/or per employee.
