American Samoa is covered by the minimum wage provisions of the FLSA, except that the minimum wage rate for the territory is set below the federal minimum wage rate for U.S. states. As established by the Fair Minimum Wage Act of 2007, the American Samoa industry-specific minimum wage rates will increase by $.40 on September 30 every three years until they reach the level of the minimum wage generally applicable in the U.S.

The American Samoa minimum wage increased on September 30, 2018. The next minimum wage update is scheduled for 2021.

Posting Requirement

The 2018 American Samoa Federal Minimum Wage Poster must be posted by every employer with one or more employees covered by the minimum wage provisions of the FLSA. It must be posted in every establishment where a covered employee works, so as to permit them to readily observe a copy. (29 C.F.R. §516.4)
