Who must post the Los Angeles County, CA Fair Workweek Poster?

  • Effective July 1, 2025, the Los Angeles County, CA Fair Workweek Ordinance (L.A.C.C. 8.102) requires large retail employers with retail employees who perform work within the unincorporated areas of Los Angeles County to post the Los Angeles County, CA Fair Workweek Poster at any workplace or job site where any covered retail employee works to inform them of their rights under the Fair Workweek Ordinance.
  • The poster must be:
    • Posted in a a visible location at each workplace or job site where any retail employee works.
    • Printed in English, Spanish, and any other language spoken by at least ten percent (10%) of the retail employees at the workplace or job site.
    • Provided to retail employees who do not have regular access to the workplace or job site by electronic communication or U.S. Mail on an annual basis.
    • Updated each July 1.

What retail employees are subject to the Fair Workweek Ordinance?

The Fair Workweek Ordinance applies to retail employees who:

  • Work at least two (2) hours per week in an unincorporated area of Los Angeles County,
  • Are entitled to minimum wage under California’s minimum wage law, and
  • Are assigned a primary work location and duties that support retail operations, including, but not limited to, a retail store or warehouse.

What retail employers are subject to the Fair Workweek Ordinance?

The Fair Workweek Ordinance applies to any retail business that employs 300 or more employees globally and either:

  1. Is identified as a retail business in the North American Industry Classification System (NAICS) within the retail trade categories and subcategories 44 – 45; or
  2. Generates its revenues primarily from the sale of personal, household, or family purposes, including appliances, clothing, electronics, groceries, and household items.

The NAICS retail sector businesses include:

  • Motor Vehicle and Parts Dealers
  • Furniture and Home Furnishings Stores
  • Electronics and Appliance Stores
  • Building Material and Garden Equipment and Supplies Dealers
  • Food and Beverage Stores
  • Health and Personal Care Stores
  • Gasoline Stations
  • Clothing and Clothing Accessories Stores
  • Sporting Goods, Hobby, Book, and Music Stores
  • General Merchandise Stores
  • Miscellaneous Store Retailers
  • Nonstore Retailers

What are the key benefits of the Los Angeles County Fair Workweek Ordinance?

The Los Angeles County Fair Workweek Ordinance gives retail employees the rights to:

  • A Good Faith Estimate of Work Schedules before the time of hire
  • At least 14 days advance notice of Work Schedules
  • Decline certain schedule changes
  • Priority for accepting additional hours offered before new staff is hired
  • Predictability Pay for accepting certain schedule changes
  • At least 10 hours of rest between shifts
  • Protection from retaliation for exercising their rights under the Ordinance
