The Minnesota Service Animals Poster informs patrons that services animals are welcome, and that it is illegal for a person to misrepresent an animal as a service dog or service dog in training.
Under the federal Americans with Disabilities Act (ADA) and Minnesota Human Rights Act, places of public accommodation must permit service animals to accompany people with disabilities in all areas of the facility where members of the public are allowed to go. A “service animal” is a dog or miniature horse that is is individually trained to do work or perform specific tasks for the benefit of an individual with a physical, sensory, psychiatric, intellectual, or other mental disability.
Effective August 1, 2018, it is illegal in the state of Minnesota for a person to intentionally misrepresent an animal in the person’s possession as a service animal or service animal in training within a place of public accommodation in order to obtain the rights and privileges available to a person who qualifies for a service animal under state or federal law.
Posting Requirements
The Minnesota Service Animals Poster is not a required posting. Places of public accommodation can voluntarily post the Minnesota Service Animals Poster to signify to the public that the posted location follows state and federal law by permitting valid service animals, but will not tolerate persons breaking state law by misrepresenting an animal as a service animal.
The Minnesota Animal Rights Poster may be conspicuously posted in a location accessible to the public. (Minnesota Statutes, 609.833.4).
