Housing Discrimination

The New Jersey Law Against Discrimination prohibits discrimination in housing based on actual or perceived:

  • Race or color;
  • Religion or creed;
  • National origin, nationality, or ancestry;
  • Sex, pregnancy, or breastfeeding;
  • Sexual orientation;
  • Gender identity or expression;
  • Disability;
  • Marital status or domestic partnership/civil union status;
  • Liability for military service;
  • Familial status (having children under age 18); and
  • Source of lawful income used for rental or mortgage payments.

The prohibition applies to real estate agents and housing providers. Also under the New Jersey Law Against Discrimination, it is unlawful to publish real estate advertisements which express any discrimination against persons protected by the law.

Posting Requirements

Real estate agents, brokers, financial institutions, property owners, or building superintendents, their agents and employees are required to display the New Jersey Discrimination in Housing: Sales and Rentals Poster (#30700) in places easily visible to all prospective tenants and purchasers. (N.J.A.C. 13:8-1.3)

Persons engaged in the management of residential real property, including, but not limited to, landlords, property management companies, and cooperative and condominium associations are required to display the New Jersey Discrimination in Housing: Property Management Poster (#30305) in places easily visible to all prospective tenants and purchasers. (N.J.A.C. 13:8-1.3)
