The New York Smoking or Vaping Permitted Poster informs individuals that smoking or vaping is permitted within the posted area.
On October 23, 2017, S.B. 2543 was passed adding electronic cigarettes to the Clean Indoor Air Act. The amended Act bans the use of electronic cigarettes everywhere that smoking tobacco products are prohibited. However, smoking is permitted in:
- a hotel or motel room rented to one or more guests,
- retail tobacco businesses (primary activity is the retail sale of tobacco products and accessories, and the sale of other products is merely incidental),
- membership associations where all duties related to the operation of the association are performed by volunteers who are not compensated in any manner, and
- cigar bars.
Posting Requirements
Every employer or entity in charge of a place where smoking is permitted must prominently display the New York Smoking or Vaping Permitted Poster at each entrance and exit to the place of employment or public place. Violations of the New York Clean Indoor Air Act may result in a penalty of up to $1,000. For more information about the Act, visit the State of New York Department of Health website.
