The North Dakota Smoking Prohibited Poster informs employees, patrons, and the public that smoking (including the use of an e-cigarette) is prohibited within the posted area. The poster also displays the international no smoking symbol – an image of a burning cigarette behind a crossed red “no” circle – and cites the relevant section of the North Dakota Century Code.

North Dakota law prohibits smoking, including the use of an e-cigarette, in all enclosed areas of public places and places of employment, as well as within 20 feet of entrances, exits, operable windows, air intakes, and ventilation systems of enclosed areas in which smoking is prohibited.

Posting Requirements

The person in control of an enclosed public place or place of employment is required to post the North Dakota Smoking Prohibited Poster within the premises (N.D. Century Code, §23-12-10.4).

An owner or other person with general supervisory control over a public place or place of employment who fails to comply with this requirement is guilty of an infraction and subject to fines ranging from $100 – $500 depending on frequency of the violation. Each day on which a violation of the Act occurs shall be considered a separate and distinct violation. Violation may also result in the suspension or revocation of any permit or license issued to the business on the premises.

The person in control of the enclosed space is also required to post the North Dakota No Smoking 20 Feet Poster at every entrance.
