Who must post the SBA Equal Opportunity Poster?
The SBA Equal Opportunity Poster (SBA Form 722) – also know as the equal opportunity statement – is required to be posted by any organization receiving SBA financial assistance. It should be clearly visible to all employees, applicants seeking employment and the general public. Failure to display the poster properly may be considered evidence of noncompliance and may lead to penalties from the SBA. The SBA Form 722 is used with the SBA 7(a) loan program. The form can also be used by SBA CDC/504 program participants. The form is required for Paycheck Protection Program participants.
What is covered?
This poster informs the public that the SBA participant practices equal employment opportunity and equal treatment of clients. Specifically, this poster advises patrons that the SBA does not discriminate against:
- employees and applicants on the basis of race, color, religion, sex, age, disability or national origin in the hiring, clients retention, or promotion of employees; nor in determining their rank, or the compensation or fringe benefits paid to them; and
- clients on the basis of race, color, religion, sex, marital status, disability, age or national origin in services or accommodations offered or provided to the participant’s employees, clients or guests.
This poster informs SBA participants of their obligation to inform the public or their rights under federal and SBA regulations. Failure to post may be evidence of noncompliance and subject the participant to penalties. The poster provides contact information for the Small Business Administration.
