The Americans with Disabilities Act (ADA) prohibits discrimination on the basis of disability and provides the first comprehensive civil rights to people with disabilities in the areas of employment; public accommodations; state and local government programs, services and activities; and communications. Disability is defined as a person who has a physical or mental impairment that substantially limits one or more major life activities, a person who has a history or record of such an impairment, or a person who is perceived by others as having such an impairment.

Personnel procedures must allow people with disabilities to apply, be hired, advanced or discharged, based on their qualifications and performance, not their disabilities. Employment of people with disabilities, just like all employees, should be paid based on their qualifications. They should receive the same training and benefits as other employees.

Employers are prohibited from retaliating against an applicant or employee who has opposed an unlawful employment practice; filed a charge; or testified, assisted, or participated in any proceeding, investigation, or hearing under the Act. The law applies to all public employers and private employers with 15 or more employees.

Posting Requirement

All Utah human service licensed programs or providers must display the Utah ADA Poster in a conspicuous place. License types include: adoption, adult day care, day treatment, foster care, intermediate secure care, outdoor youth program, outpatient treatment, recovery residence, residential treatment, social detox, and therapeutic schools.

The poster includes a section that must filled with the licensed agency’s ADA coordinator or the agency’s human resource office for individuals that need to make a complaint.
