What’s new?
Vermont  has enacted a new Crime Victim Leave Law. The required Employment Protections for Victims of Crime workplace posting explains key provisions of the law:
  • Who is a “victim of crime”?
  • When can crime victim leave be taken?
  • What rights do crime victims have while on leave and upon return from leave?
What is the Crime Victim Leave Law?
The Crime Victim Leave Law:
  • amends the state’s Fair Employment Practices Law by adding “crime victim status” to the list of classes protected from employment discrimination and retaliation
  • defines “crime victim” to include a person who has obtained an order against abuse, stalking or sexual assault, or who is identified as a crime victim in a law enforcement affidavit
  • creates a new crime victim leave protection which provides employees with unpaid, job-protected leave to attend proceedings related to the crime
What must employers do now?
  • ensure employees are protected from discrimination based on crime victim status and implement crime victim leave provisions immediately
  • ensure employees are informed of their rights by posting the mandatory Employment Protections for Victims of Crime Notice of Employee Rights in the workplace
