Colorado Overtime & Minimum Pay Standards Order (“COMPS Order”) #38 Poster & Notice

  • Minimum wage rate effective January 1, 2023 – $13.00 per hour.
  • Exempt salary threshold effective January 1, 2023 – $50,000 per year.

2023 FAMLI Program Notice

  • Deductions from employee wages start January 1, 2023. The premium rate through 2024 is set at 0.45% of employee wages.
  • Benefits start January 1, 2024. Leave is paid at the rate of 90% of the employee’s average weekly wages.
  • Qualifying conditions:
    • Caring for a new child.
    • Caring for the employee or a family member with a serious health condition.
    • Making arrangements for a family member’s military deployment.
    • Reasons related to domestic violence, stalking, sexual assault, or sexual abuse.
  • Employee protections:
    • Job protection and continuation of health benefits while on leave.
    • Protection from retaliation, discrimination, and interference with the exercise of FAMLI rights.

Who must post?
  • Every employer subject to the COMPS Order must display the COMPS Order posting in area frequented by employees, where it may be easily read during the workday. (7 CCR §1103-1)
  • Every Colorado employer with one or more employees is required to post the FAMLI Program Notice in a prominent location in the workplace. (CRS §8-13.3-511)
  • Every employer with 15 or more employees is required to post the Federal Know Your Rights: Workplace Discrimination is Illegal posting in a place where it can be seen by employees and job applicants. (42 USC 2000e-10)
