What’s new?
- As a result of legislation enacted this year, the New Mexico Human Rights Bureau has added “Pregnancy, Childbirth or Related Condition” to the protected categories listed on the Discrimination is Against the Law posting.
- Under the law, an employer may not:
- hire, fire or discriminate in compensation, terms or conditions of employment against an employee or job applicant based on pregnancy, childbirth or related condition
- refuse or fail to make reasonable accommodation for an employee or applicant with a need arising from pregnancy
- require an employee with a need arising from pregnancy to take leave if another reasonable accommodation can be provided
Who must post?
All New Mexico employers are required to post the New Mexico 2020 Discrimination is Against the Law posting in a conspicuous place on their premises. (NMSA § 28-1-14)
