What’s Changed?
Last year, the U.S. Department of Labor issued a final rule that changed the overtime provisions of the Fair Labor Standards Act (FLSA). The rule, which took effect January 1, 2020, updated the minimum salary thresholds necessary to exempt executive, administrative, or professional employees from the FLSA’s minimum wage and overtime pay requirements.
To align more closely to federal overtime regulations, the Pennsylvania Department of Labor and Industry announced new overtime thresholds for executive, administrative and professional workers effective October 3, 2020. Accordingly, the Pennsylvania redesigned the Minimum Wage posting. The posting includes new information on hours exempt from overtime rates for air carrier employees subject to the provisions of Title II of the Railway Labor Act. The posting also includes the new website address for the Pennsylvania Department of Labor and Industry.
Who must post?
Every employer subject to the Pennsylvania Minimum Wage Act must post the current Minimum Wage posting in a conspicuous place where employees can read it. (Pennsylvania Minimum Wage Act, Section 8)
