Posting Update Details
What changed?
- The overtime exemption providing for the calculation of overtime for employees of bowling establishments and institutions providing on premise care (other than hospitality) to the sick, the aged, or individuals with disabilities, based on a 48-hour workweek was removed from the posting.
Why?
- Employees of bowling establishments and institutions providing on premise care (other than hospitality) to the sick, the aged, or individuals with disabilities are entitled overtime as provided under the Federal Fair Labor Standards Act (FLSA). The FLSA overtime calculation is more favorable to employees and does not limit the calculation of such employees’ overtime based on a 48-hour workweek.
Who must post?
- All Maryland employers are required to keep posted conspicuously in each workplace the current Maryland Department of Labor Minimum Wage and Overtime Law posting. (Md. Lab. & Empl. § 3-423)
- All Maryland Department of Labor postings have been revised to reflect the Department’s updated address.
