Labor Law Requirements for California Employers Include Mandatory Pamphlets

Employers have many different responsibilities under California Labor laws.  Among these is the mandatory requirement to provide employees with specified pamphlets, notice of Unemployment and Workers’ Compensation Insurance, State Disability Insurance, Paid Family Leave and Sexual Harassment. California mandatory pamphlet distribution requirements are in addition to the state and federal mandatory-to-post laws for the state.

California employers are required to provide to each employee the “California Programs for the Unemployed” pamphlet, when appropriate. This pamphlet provides information on programs offered by the California Employment Development Department to assist unemployed Californians. Included is important information on disability, paid family leave, and Job Service benefits available to the employee.

All California employers who have employees subject to State Disability Insurance (SDI), the partial wage-replacement insurance plan for California workers, are required to provide the Disability Insurance Provisions and Paid Family Leave pamphlets.  State Disability Insurance (SDI) pamphlets must be distributed to all new hires and again if the employee should go out on disability leave.  Also, employers must distribute the Paid Family Leave (PFL) pamphlet to all new hires and employees requesting time off for a covered reason, as specified under the law.

Under the California Workers’ Compensation Law, the “Your Rights to Workers’ Compensation Benefits and How to Obtain Them” pamphlet must be provided to every new employee, either at the time of hire or by the end of the first pay period.  It is important to note this notice must be provided to those Spanish-speaking employees in Spanish.

The California Department of Fair Employment and Housing has legislative authority for enforcement of the protection of the people of California from unlawful discrimination in employment, housing and public accommodation, and the perpetration of acts of hate violence. All employers must take the following actions against harassment:

  • Take all appropriate steps to prevent discrimination and harassment from occurring.
  • Develop and implement a sexual harassment prevention policy which shall include procedures for employees to make complaints and for the employer to investigate complaints.
  • Distribute the sexual harassment pamphlet to all employees at the time of hire. The pamphlet, however, may not be used in place of a sexual harassment prevention policy.

Employers who do business in California and employ 50 or more part-time or full-time employees have an additional obligation in that they must provide at least two hours of sexual harassment training for supervisors every two years.  This requirement applies to each supervisory employee as well as all new supervisory employees. The training for new supervisory employees must be conducted within six months of the employee’s assumption of the supervisory position and thereafter, every two years.
