Minimum wage compliance is a top priority for employers. Compliance Poster Company works diligently to keep employers in compliance with state and federal labor and employment-related laws. Recently the North Dakota Department of Labor and Human Rights released an updated Minimum Wage & Work Conditions Summary Notice which contains important administrative changes. Employers must have the updated version on break room walls for employees to view.
Changes to the Minimum Wage & Work Conditions Summary poster include:
- The addition of a new section “Limitations on Paid Time Off” which addresses that a private employer may withhold payment for accrued paid time off under three (3) specific conditions when an employee voluntarily separates from employment
- Clarification to the “Deduction from Pay” section outlining those deductions that are considered legal under state and federal law
- Definition of “service employee” and respective examples have been added to the “Tip Credit” section
- Addition of two (2) bulleted paragraphs to the “Exemptions from Overtime” section.
- Address highly compensated employees and describe who they are and weekly pay amounts and duties, and
- Employees providing companionship services outlining duties and that no more than 20% of the hours worked in the week may be household work (cleaning, laundry, or meal preparation).
