District of Columbia Revises Minimum Wage and Paid Sick Leave Notices; New DC Labor Law Poster Required

The District of Columbia has updated two mandatory workplace postings:

  • District of Columbia Minimum Wage Poster
  • Accrued Sick and Safe Leave Act

District of Columbia Minimum Wage Poster

Earlier this year, the District of Columbia’s Minimum Wage Revision Act was amended to provide for increases in the District’s hourly minimum wage rate beginning July 1, 2014.  The Minimum Wage posting has been updated to reflect three incremental minimum wage increases:

  • July 1, 2014 $9.50 per hour
  • July 1, 2015 $10.50 per hour
  • July 1, 2016 $11.50 per hour

Subsequent minimum wage increases based on the Consumer Price Index begin July 1, 2017.  In addition, several portions of text relating to tipped employees, overtime and paid sick leave have been revised.  Old wage rates and other portions of text were removed from the posting.

Accrued Sick and Safe Leave Act (ASSLA)

By an amendment to the Accrued Sick and Safe Leave Act enacted in February, the definition of employees protected by the act has been expanded to include tipped employees of restaurants and bars.  For all employees, the posting clarifies when accrual starts, when employees may begin to use their leave and the amount of leave, depending on the size of the employer.

The amendment also strengthens the remedies available to employees under the act.  The Department of Employment Services’ enforcement powers have been expanded and fines for violations have doubled.  The deadline for filing a complaint for a violation of the act has been extended to three years.
