Delaware Adds New Discrimination Protections – New Employment Discrimination Posting Required

The Delaware Department of Labor has updated the state’s mandatory Employment Discrimination posting. As previously shared in our blog, Delaware passed new employment discrimination laws that would affect the Employment Discrimination posting. The first new law (H.B. 316) makes it unlawful for an employer to discriminate against an employee because of a reproductive health decision. The second new law (H.B. 317) makes it unlawful for an employer to discriminate based on family responsibilities. The posting has also been revised to add that employers cannot discriminate based on an employee’s membership in a voluntary emergency responder organization.

The laws apply to employers of four or more employees, labor organizations, employment agencies and joint labor management committees for apprenticeship or training. The laws protect individuals from discriminatory practices hiring, firing, pay or other terms, conditions, privileges or responsibilities of employment.

Employers with four or more employees are required to post the Employment Discrimination posting in a conspicuous place. Employers with a Delaware All-On-OneTM Labor Law Poster can comply with a 2017 Employment Discrimination Peel ‘N PostTM, or purchase a new 2017 Delaware All-On-OneTM Labor Law Poster that includes the updated posting.
