What’s new?

Recent amendments to the British Columbia Employment Standards Act expand employees’ pregnancy leave, parental leave and compassionate care leave entitlements and establish two new leave entitlements, crime-related child disappearance leave and leave respecting the death of a child.

Pregnancy Leave
May begin up to 13 weeks before due date
Parental Leave New mothers up to 61 weeks after pregnancy leave; non-birth and adopting parents up to 62 weeks within 78 weeks of birth or placement
Compassionate Care Up to 27 weeks within a 52-week period
Crime-related Child Disappearance Leave Up to 52 weeks from date of disappearance and lasting up to14 days after child is found or until child is found deceased
Child Death Leave Up to 104 weeks from the date the child dies or is found deceased

What else should employers know?

Employee leaves are unpaid. Leaves are job-protected. Employees must be restored to the same or a comparable position upon return from leave. Employment is considered continuous for purposes of wages and benefits.
