What’s New?
  • Amended Minimum Wage Order #35 Notice:

The Colorado Department of Labor and Employment (CDLE) has adopted Amended Minimum Wage Order #35, which implements a voter-approved increase in the state’s minimum wage rate. Effective January 1, 2020, Colorado’s Minimum Wage Rate increases to $12.00 per hour. The tipped employee minimum wage rate increases to $8.98 per hour.

  • Employment Anti-Discrimination Notice:
The updated posting describes:
  • employee protection from discriminatory employment practices and protected classes;
  • employees’ right to reasonable accommodations for their disabilities;
  • employees’ right to reasonable accommodations for their conditions related to pregnancy, as required by the Pregnant Worker Fairness Act;
  • employee protection from retaliation for opposing discriminatory practices; and
  • employees’ right to share wage information.
What’s Next?
Amended Minimum Wage Order # 35 is temporary. A new wage order, Colorado Overtime and Minimum Pay Standards (COMPS) Order #36, is scheduled to go into effect on March 1, 2020. COMPS Order #36 is intended to better reflect modern labor markets and eliminate confusing terminology. Employers are required by law to post the Amended Minimum Wage Order #35 Notice now. (7 C.C.R. 1103-1) Employers will be required to update again in March with the release of the COMPS Order #36 Notice. (Proposed Rule 7.4)
