What’s new?
Earlier this year, Governor Phil Murphy signed into law Assembly Bill 5843. The law requires employers to post a misclassification notice that includes the following information:
  • An explanation of the prohibition for an employer to misclassify its employees;
  • The standard that is applied by the Department of Labor and Workforce Development to determine whether one is an employee or an independent contractor;
  • The benefits and protections to which an employee is entitled under State wage, benefit and tax laws;
  • The remedies which workers affected by misclassification may be entitled to New Jersey law; and
  • Information on how a worker or a worker’s authorized representative may contact, by telephone, mail and e-mail, a representative regarding possible worker misclassification.
The New Jersey All-On-One Labor Law Poster has been reformatted to include the new Employee Misclassification notice.


Who must post?

Every employer subject to New Jersey’s wage, benefit and tax laws must post the Employee Misclassification notice in a conspicuous and accessible place in or about the premises where a covered employee is employed. (N.J.R.S. 34:1A-1.19)
What else do I need to know?
To be in full compliance, you must also post the New Jersey Whistleblower Act Poster in English and Spanish.
