What’s new?
Due to the COVID-19 pandemic, the federal government has expanded the availability of unemployment compensation. President Trump signed the Families First Coronavirus Response Act (FFCRA), which among many things, appropriated $1 billion in federal funds for unemployment compensation. To receive funds, the states must require employers to provide notification of the availability of unemployment compensation to employees at the time of separation. The states must also ensure that applications for benefits and assistance be accessible in at least two mediums (in-person, by phone or online). South Dakota has revised its mandatory Unemployment Compensation Notice to include the required information.
Who must post?
Every employer subject to the South Dakota Reemployment Assistance Law must post the Unemployment Compensation Notice in a conspicuous and accessible place in or about the premises where a covered employee is employed. (SDLRC §61-7-1)
What else do I need to know?
Covered employers are required to distribute the Unemployment Compensation Notice to employees upon separation. The notice can be accessed from our Free Labor Law Compliance Postings webpage.
