What does the Lactation Support Act require?
  • An employer is required to provide reasonable unpaid break time, or paid break time or mealtime, to permit an employee to express breast milk.
  • An employer must make reasonable efforts to provide a room or other location, other than a toilet stall, near the work area where an employee may express milk in privacy.
  • An employer may not discriminate against an employee for requesting or using reasonable break time to express breast milk in compliance with the Act.
  • An employer is not required to provide break time if doing so would create an undue hardship on the operations of the employer.
  • If any adverse action is taken against an employee for requesting or using reasonable break time to express breast milk, the aggrieved employee may file a charge of discrimination with S.C. Human Affairs Commission (SCHAC).
Who must post?
All employers, regardless of size, and the State and its political subdivisions, are subject to the South Carolina Lactation Support Act. Employers are required to post in conspicuous places upon their premises the SCHAC Employment Discrimination posting providing notice of the law and information pertinent to the filing of a complaint. (S.C. Code § 41-1-130; SCHAC Reg. 65-24).
