What’s new?
- The Ohio Constitution (Art. II § 34a) requires the State minimum wage rate to be adjusted each year for inflation, as measured by the increase in the Consumer Price Index rounded to the nearest 5 cents. Between 2019 and 2020, the CPI increased 1.4%.
- Employers who meet the annual gross revenue threshold must pay their employees no less than the rate specified in Art. II-34a, as adjusted by the Ohio Department of Commerce. (ORC § 4111.02)
- In 2021, employers with gross receipts of more than $323,000 per year must pay at least the State minimum wage rate. Employers that gross $323,000 or less must pay no less than the Federal minimum wage rate.
- Effective January 1, 2021, Ohio minimum wage rates have been adjusted as follows:
- Minimum Wage Rate – $8.80 per hour
- Tipped Employee Minimum Wage Rate – $4.40 per hour, plus tips
Who must post?
- All businesses subject to the minimum wage provisions of Ohio Revised Code §§ 4111.01-4111.17, must post the Ohio 2021 Minimum Wage notice in a conspicuous and accessible place of the premises where it can be seen by employees. (ORC. § 4111.09)
- Failure to post the Ohio 2021 Minimum Wage notice is a fourth degree misdemeanor which carries a fine of up to $250 for each day of non-compliance and potential jail time of up to 30 days. (ORC §§ 4111.13, 4111.99, 2929.28, 2929.24)
