What’s new?
On November 18, 2021, the District of Columbia COVID Vaccination Leave Emergency Act of 2021 retroactively amended the District’s COVID-19 Leave provision and created the New COVID-19 Leave. Effective November 5, 2021, employees who work for an employer with 20 or more employees in the District may use up to 16 weeks of New COVID-19 Leave if the employee:
- Or a person with whom the employee lives with has tested positive for COVID-19
- Or a person with whom the employee lives with has a government or healthcare provider’s order to isolate or quarantine
- Must care for a family member or a person with whom the employee lives with is isolating or quarantining pursuant to Department of Health Guidance, the recommendation of a health care provider, or the order or policy of the family member’s or individual’s school or childcare provider
- Must care for a child whose school or place of care is closed or whose childcare provider is unavailable due to COVID-19
Who must post?
All employers with 20 or more employees in the District, are required to post and maintain the New COVID-19 Leave Poster in a conspicuous place. (DC Code, Section 32-511) An employer who fails to comply with the posting requirement is subject to a penalty of $100 for each violation.
