California 2022 COVID-19 Supplemental Paid Sick Leave (SPSL)

What’s new?
The California 2022 COVID-19 Supplemental Paid Sick Leave (SPSL) went into effect on February 19, 2022, providing covered employees with up to 80 hours of supplemental paid sick leave during the time period of January 1, 2022 through September 30, 2022.

Who is covered?

  • Employers: California public and private sector employers who employ more than 25 employees.
  • Employees who are unable to work or telework for any of the specified COVID-19-related reasons below.

How much leave is available?
Up to 40 hours of SPSL may be used for the following reasons:

  • the employee is attending an appointment for a COVID-19 vaccination or booster shot, or for the recovery from vaccination-related symptoms, for the employee or a family member (an employer may limit to 24 hours/3 days);
  • the employee is subject to a COVID-19 quarantine or isolation period by order or guidance from a public heath official, or on the advice of a healthcare provider, or is experiencing symptoms of COVID-19; or
  • the employee is caring for a family member who is subject to a COVID-19 quarantine or isolation period, or is caring for a child whose school or place of day care is closed or unavailable due to COVID-19.

Up to 40 hours of additional SPSL may be taken if:

  • The employee tests positive for COVID-19; or
  • The employee is caring for a family member who tests positive for COVID-19.

Who must post? 
California public and private sector employers with more than 25 employees are required to display the California 2022 COVID-19 Supplemental Paid Sick Leave Poster in a conspicuous location in each workplace of the employer. (Lab. Code § 248.6(d)).
