Colorado Mandatory Poster Update

• Colorado Public Health Rights Poster – The posting has been updated consistent with Senate Bill 23-017, providing that employees may use accrued Healthy Families & Workplaces Act (“HFWA”) leave for the following needs:
  • To grieve, attend a funeral/memorial service, or deal with financial/legal needs after a death of a family member.
  • Due to inclement weather, power/heat/water loss, or other unexpected occurrence, the employee needs to either (a) evacuate their residence, or (b) care for a family member whose school or place of care was closed.
  • For specified purposes, additional leave hours are available during a Public Health Emergency (PHE). No PHE is presently in effect.
• Colorado Law Prohibits Discrimination in Employment – The posting has been revised to reflect a change in the Colorado Anti-Discrimination Law pursuant to Senate Bill 23-172, prohibiting discrimination in employment based on marital status.

Who must post?

• All employers are required to display the Colorado Public Health Rights Poster in each establishment, in a conspicuous location frequented by employees where it may be easily read during the workday. (7 CCR § 1103-11)
• All employers are required to conspicuously post and maintain the Colorado Law Prohibits Discrimination in Employment in each establishment, in easily accessible and well-lit places customarily frequented by employees and applicants for employment. (3 CCR § 708-1-20.1)
