What’s new?
The New Mexico Minimum Wage Act Employee Rights posting has been revised to reflect new minimum wage rates effective January 1, 2023:
- Minimum wage rate: $12.00 per hour.
- Tipped minimum wage rate: $3.00 per hour.
- The City of Santa Fe and Santa Fe County have higher minimum wage rates. Albuquerque and Las Cruces have higher tipped minimum wage rates.

Who must post?
- Every employer subject to the New Mexico Minimum Wage Act must post the Minimum Wage Act Employee Rights posting in a conspicuous place on or about the premises where any covered employee is employed. (NMSA § 50-4-25).
- Every employer who has 15 or more employees is required to post the Federal “Know Your Rights” posting in a place where it can be seen by employees and job applicants. (42 USC 2000e-10).
