What’s new?
- The Colorado Overtime & Minimum Pay Standards Order (“COMPS Order”) #39 posting was updated to reflect that:
- Effective January 1, 2024, the Colorado minimum wage rate is $14.42/hour.
- Local minimum wage rates are posted at ColoradoLaborLaw.gov.
- Employers can pay tipped employees up to $3.02/hour below the highest applicable minimum wage rate (Colorado or local).
- In agriculture, overtime is paid after 48-56 hours, based on size and seasonality; there are extra breaks and pay on long days.
- COMPS exemptions include: executives/supervisors, administrators, and professionals paid a salary of at least $55,000 in 2024; highly technical computer employees paid at least $33.17/ hour; and other highly compensated employees paid a salary of at least $123,750 in 2024.
- The Colorado Law Prohibits Discrimination in Employment posting was updated by removing obsolete information relating to the filing deadline for certain employment discrimination complaints.
Who must post?
- The Colorado Overtime & Minimum Pay Standards Order posting must be posted by every employer subject to the COMPS Order in area frequented by employees where it may be easily read during the workday. (7 CCR § 1103-1 Rule 7.4.1)
- All Colorado employers must post and maintain the Colorado Law Prohibits Discrimination in Employment posting in easily accessible and well-lit places customarily frequented by employees and applicants for employment. (3 CCR § 708-1 Rule 20.1)
