Employers are required by Connecticut workplace law, Section 31-48d to give employees notice if they use electronic monitoring in their organization, prior to actually doing so. Under the law, an employer is any person, firm or corporation, including the state and any political subdivision of the state which has employees.
Electronic monitoring in Connecticut consists of the collection of information on any employer’s premises concerning employees’ activities or communications by any means other than direct observation. This includes the use of a computer, telephone, wire, radio, camera, electromagnetic, photo electronic or photo-optical systems. It does not however include, collection of information for security purposes in common areas of the employer’s premises which are maintained for use by the public or that which is prohibited under state or federal law.
