On January 1, 2019, 20 states, including Arizona, will raise the hourly pay rate for minimum wage workers. Employers are required to pay employees at least the new minimum wage rate and post a notice in the workplace to inform employees of their right to the minimum wage. The Industrial Commission of Arizona has released the 2019 Arizona Minimum Wage notice with plenty of time to spare for employers to comply by the new year. Employers with employees who work in the City of Flagstaff, AZ have additional minimum wage requirements.

WHAT DO EMPLOYERS NEED TO KNOW ABOUT THE 2019 Arizona MINIMUM WAGE?
Arizona voters passed Proposition 206, or the Fair Wages and Healthy Families Act, in November of 2016. The law provides employees with earned paid sick leave and set up a series of scheduled increases to the minimum wage that began in January of 2017. Arizona will incrementally raise the state minimum wage to $12.00 per hour by 2020, after which it will rise relative to changes to the Consumer Price Index (CPI), which measures cost of living in the U.S.
Effective January 1, 2019, the minimum wage will increase to $11.00 per hour for non-tipped workers in the state of Arizona. The minimum wage for tipped workers is always set at $3.00 less than the general minimum wage, so in i2019 it will be set at $8.00 per hour.
The 2019 Arizona Minimum Wage Poster must be conspicuously posted by every employer operating in the state of Arizona, except those exempt from the Fair Wages and Healthy Families Act. Businesses are exempt if they gross less than $500,000 in annual revenue. (Arizona Revised Statutes, Sec. 23-364(D)) The 2018 poster should remain posted until December 31, 2018 and be replaced by the 2019 Arizona Minimum Wage Poster on January 1.

2019 FLAGSTAFF MINIMUM WAGE POSTER UPDATE
Employers with one or more employees who work 25+ hours in the City of Flagstaff are required to pay a higher minimum wage and post the 2019 Flagstaff Minimum Wage Poster in addition to the state and federal minimum wage posters. Effective January 1, 2019, the municipal minimum wage for Flagstaff will increase to $12.00 per hour worked within the city.
Like the state increase, the municipal minimum wage came about as the result of a voter initiative. In November of 2016, voters passed Proposition 414 to raise minimum wage for workers in the city to $15.50 by the year 2022 and increase according to the rise in inflation thereafter, with the additional requirement that the Flagstaff minimum wage always remain at least $2.00 above the state minimum wage.
The ordinance also gradually increases the minimum wage for tipped workers until it reaches the same level as the general minimum wage in 2026, thereby eliminating the tip allowance that is often relied on by restaurant owners to make up a portion of employee wages. A business-backed initiative on the November 2018 ballot would have eliminated the tip allowance fadeout and lowered the general minimum wage to just $.50 above the state level, but voters rejected the measure.
The 2019 Flagstaff Minimum Wage Poster provides the new general minimum wage rate and the time period during which it will be in effect, as well as information about who is covered, employee rights, and retaliation and contact information for the Flagstaff Office of Labor Standards. The updated poster also contains two new sections on tipped employees and compliance, along with a bright new teal and yellow color scheme.
The 2019 Flagstaff Minimum Wage Poster must be displayed in a conspicuous place at any workplace or job site where a covered employee works. It must be posted in both English and Spanish, and in any language spoken by more than 5% of the employer’s workforce within the city.

Employers are also required to provide new hires with a minimum wage handout (in English or Spanish) and an employee signature form which must be signed by the employee. These have also been updated for 2019.
