Paid Sick Leave Posting Details
New Mexico’s Paid Sick Leave Law (50-17-1 et. seq.) goes into effect on July 1, 2022. The Paid Sick Leave Law applies to:
- All New Mexico employers with one or more employees
- All employees, whether they are full-time, part-time, seasonal, or temporary, and whether they are hourly, salaried, or paid by task, piece, or commission
What does the Paid Sick Leave posting cover?
- Accrual of Paid Sick Leave is one hour of leave for every 30 hours worked
- Use of Paid Sick Leave is up to 64 hours per 12-month period
- Reasons for taking Paid Sick Leave include:
- Treatment of the employee’s own health condition or for preventative medical care.
- Caring for a family member treating a health condition or for preventative medical care.
- Meetings related to employee’s child’s health or disability.
- Reasons related to domestic abuse, sexual assault, or stalking.
- Notice, documentation, and recordkeeping requirements
- Prohibition of retaliation against employees for exercising their rights
- Complaint process including how and when to file a complaint
Who must post Paid Sick Leave?
- All New Mexico employers are required to display the Paid Sick Leave posting in a conspicuous and accessible location of the workplace. (N.M.S.A. § 50-17-6).
- The posting must be displayed in English, Spanish and any language spoken by at least 10% of the workforce.
