California Businesses Must Post New Human Trafficking Notice, Effective Now!

An important California Senate Bill enacted in 2012 became effective April 1, 2013. By law, specific businesses must post the New California Human Trafficking notice in each establishment near public entrances (Civil Code Section 52.6). Human Trafficking is a crime and violates the nations promise that everyone is guaranteed basic human rights.  Did you know?…The California Department of Justice estimates that 14,500 to 17,500 victims are trafficked into the United States each year.

The required notice, which was developed by the California DOJ, informs employees, the public and victims of the resources that are available. There are nonprofit, nongovernmental organizations that provide services to help eliminate human slavery and trafficking. Help is available 24/7 by calling one of the phone numbers listed on the poster.

What Businesses Must Post the Notice?

1. Alcohol Beverage Control Act licensees that sell alcoholic beverages for on-site consumption (taverns, saloons, night clubs or similar establishments)
2. Adult or sexually oriented businesses
3. Primary airports
4. Intercity passenger rail or light rail stations
5. Bus stations
6. Truck stops
7. Emergency rooms within general acute care hospitals
8. Urgent care centers
9. Farm labor contractors
10. Privately operated job recruitment centers
11. Roadside rest areas
12. Businesses or establishments that offer massage or bodywork services for compensation

Where the Human Trafficking Must be Posted:

The notice must be posted in a conspicuous place near the public entrance of the establishment or in another conspicuous location in clear view of the public and employees.

Posting Notice Requirements:

The mandatory notice is required to be posted in English and Spanish. In addition, for businesses located in specific counties, a third language posting is required. The specified businesses and other establishments must post the notice in English, Spanish, and in one other language that is the most widely spoken language in the business or establishment’s location (and for which translation is mandated by the Voting Rights Act, 42 U.S.C. § 1973, et seq.).

Liability and Penalty for Failing to Post Human Trafficking Notice:

Civil Code § 52.6(e) creates civil liability for a business or establishment that fails to comply with the posting requirement. The penalty for violating this law is $500 for a first offense and $1,000 for each subsequent offense.
