What Changes Are Effective January 1, 2020?
  • AB 9 – The deadline to file a complaint for workplace discrimination, harassment or retaliation with the California Department of Fair Employment and Housing (DFEH) is extended to three years.
  • SB 188 – The term “race” is defined to include traits historically associated with race including, but not limited to, hair texture and protective hairstyles.
What changes were made to the required postings?
  • Workplace Discrimination & Harassment – Adds to the protected characteristic “race” hair texture and protective hairstyles, such as braids, locks and twists; provides that discrimination complaints must be filed with the DFEH within three years of the last act of discrimination/harassment; for employees under 18, complaints must be filed within 3 years of the discrimination or 1 year after the victim’s 18th birthday, whichever is later.
  • Transgender Rights in the Workplace – Reflects the extension of time to file a DFEH complaint for discrimination to 3 years.
  • Your Rights and Obligations as a Pregnant Employee – Explains eligibility for leave under the California Family Rights Act (CFRA) and the New Parent Leave Act (NPLA).
  • Family Care & Medical Leave & Pregnancy Disability Leave – Adds contact information for the DFEH.
