What changed?

The Wage and Hour Notice to Employees has been updated to reflect that state law exempts certain categories of employees from overtime pay requirements and provides the state statute listing those exemptions. In addition, the posting clarifies employees’ protection from discrimination for exercising rights protected under the Retaliatory Employment Discrimination Act (REDA).

What’s new?
  • Overtime – This section includes a specified statement regarding the state law exemption of certain types of employees from overtime pay requirements and the exemption of employees who are classified as exempt under the FLSA. This replaces the outdated text regarding employees of seasonal amusement or recreational establishments who were made exempt from overtime pay in 2018.
  • Retaliatory Employment Discrimination – This section has been revised to clarify that the Retaliatory Employment Discrimination Act (REDA) protects employees from retaliation for filing a claim or complaint under any of the listed statutes. Drug Paraphernalia complaints has been added to the list. REDA complaints are investigated by the Retaliatory Employment Discrimination Bureau.
Who must post?
All employers are required to post the Wage and Hour Notice to Employees summarizing the provisions of law relative to the employment of adults and children and the regulation of wages, hours, and working conditions in North Carolina (NCGS § § 95-25.9, 95-25.15)
