New Mexico Discrimination is Against the Law
- Pursuant to 2023 New Mexico House Bill 207, “gender” has been added to the list of protected categories in employment.
- The legislation reflects an expansion of the Human Rights Act, making it an unlawful discriminatory practice for an employer, employment agency, or labor organization to discriminate against job applicant or employee based on gender.
- The posting was also updated to clarify that it is unlawful for an employer to discriminate against any person who has participated in any proceeding under the Human Rights Act.
- New Mexico employers with four or more employees are required to post the updated discrimination posting in a conspicuous place on the premises of the employer. (NMSA § 28-1-14)
