What’s new?
- Virginia law requires the Commissioner of Labor and Industry to annually adjust for inflation the maximum civil penalties for workplace safety and health violations, measured by the increase, if any, in the Consumer Price Index over the previous calendar year. (Va. Code 40.1-49.4P)
- The 2023 Job Safety and Health Protection posting has been updated to reflect the maximum civil penalties for safety and health violations occurring on or after August 1, 2023.
- The penalty amounts are:
- For each serious violation – $15,375
- For each other-than-serious violation – $15,375
- Failure to correct violations – $15,375 per day
- For each willful or repeat violation – $153,742
Who must post?
- All Virginia employers are required to post and keep posted the Virginia Job Safety and Health Protection posting in a conspicuous location in each workplace. (16 V.A.C. § 25-60-40)
